1001711679 Ontario Inc., operating as PaidSmile, an Ontario corporation with its registered office in Ancaster, Ontario, operates this service. Business name registered under the Business Names Act (Ontario).
1. Agreement
These terms govern your use of the PaidSmile website and booking service. By using the service you accept them.
2. What PaidSmile is, and is not
PaidSmile (1001711679 Ontario Inc.) is a booking and matching service. We help you find a dental practice in Ontario, request an appointment, and receive a reward for attending.
PaidSmile is not a dental practice. We do not provide dental care, advice, diagnosis or treatment. We do not employ, supervise, direct or control any dentist or practice listed on the service. The dentist you choose is solely responsible for the care they provide and for their own professional and regulatory obligations.
Nothing on the service is medical or dental advice. If you have a dental emergency, contact a dentist or hospital directly rather than using this service.
How PaidSmile is paid
The dental practice pays PaidSmile a fee when a patient introduced through this service attends an appointment. That fee is a flat amount agreed in advance. It does not vary with the treatment you receive, the value of that treatment, or anything you spend at the practice, and no fee is payable if you do not attend.
You never pay PaidSmile anything. Your reward is funded and issued by PaidSmile alone — the practice does not fund it, does not decide who receives it, and it has no bearing on the care you are offered or what you are charged for it. The fee is agreed with each practice in advance of any patient being introduced.
3. Who can use it
You must be at least 18 and resident in Ontario. A parent or guardian may book for a child and is responsible for the information provided and for the child's attendance.
4. Booking
When you request an appointment we pass your details to the practice you selected. A request is not a confirmed appointment until the practice confirms it. Availability shown reflects what practices tell us and may change.
The practice sets its own fees. We do not set, influence, or receive any share of what you pay for treatment.
5. Your account and conduct
You agree to give accurate information, to use one account, and not to:
- submit a receipt or claim for a visit that did not happen, or that was not booked through PaidSmile;
- alter, reuse, or fabricate any document submitted to us;
- create multiple accounts to claim more than one reward;
- arrange with anyone at a practice to record a visit that did not occur;
- scrape, copy, or resell any part of the service.
If we reasonably determine you have done any of the above, we may suspend or close your account and withhold any unpaid reward. Where a reward has already been paid, we may seek to recover it only where fraud is established through the review process in the Reward Program Terms, or by legal proceedings.
6. Rewards
The reward program is governed by the Reward Program Terms, which form part of these terms. Rewards are funded and issued by PaidSmile. Your dentist does not pay them and plays no part in deciding who receives one.
7. Our content
The PaidSmile name, logo, site design and content belong to us. You may use the service for its intended purpose and nothing more.
8. Service availability
We provide the service as it is. We do not promise it will be uninterrupted or error-free, and we may change or withdraw features.
9. Limitation of liability
To the fullest extent permitted by Ontario law, PaidSmile is not liable for any dental care you receive, for any act or omission of a practice, or for indirect, incidental or consequential losses. Our total liability for any claim relating to the service is limited to the greater of $1,000 and the total rewards paid to you in the 12 months preceding the claim.
Nothing in these terms excludes liability that cannot be excluded by law, including under Ontario's Consumer Protection Act, 2002.
10. Indemnity
You agree to indemnify PaidSmile against claims arising from your breach of these terms, including any fraudulent reward claim.
11. Governing law
These terms are governed by the laws of Ontario and the federal laws of Canada applicable there. The courts of Ontario have jurisdiction.
12. Changes
We may update these terms. Material changes will be notified before they take effect. Continuing to use the service after that means you accept them.
13. General
Severability. If any provision is held invalid, it is severed and the rest continues in force.
Survival. Sections 2, 5, 9, 10, 11 and 13 survive termination of your account.
Closing your account. You may close your account at any time by contacting us. A reward already verified as earned will still be paid, absent a finding of fraud.
Assignment. You may not assign these terms. We may assign them to a successor of our business, on notice to you.
No waiver. A failure to enforce a provision is not a waiver of it.
Entire agreement. These terms, the Reward Program Terms and the Privacy Policy are the whole agreement between us.
